Why do disputes happen in Major Projects and what can be done to avoid them?

Summary

Contractual disputes continue to hinder the effective delivery of major projects across the UK. They can happen due to factors outside the control of the parties, unclear or ambiguous contractual provisions, poor behaviour, or changes in key personnel, scope or requirements. Regardless of the cause, most disputes are highly disruptive and costly in terms of time and programme. At this Major Projects Association evening meeting speakers discussed their experience of disputes on major projects, and shared ideas on how, as an industry, we can take steps to avoid them in the future. A number of key themes emerged regarding the most common – and most avoidable – causes of disputes on major projects.
